1) A consent from the patient is not required in an emergency situations. If a child is in an emergency, professionals can treat the child despite of parent’s objections. In some cases unliterate parents do not know the seriousness of child’s diseases. They may opt to give some medication to relieve the child’s chest pain, in case where the child need an emergency surgery. Some parents are surgery phobic, and will deny to do.
Inorder to save patients life the physician can go for surgery without consent.
2) A capacity is a person’s ability to give informed consent to a particular treatment decision in a particular time. According to the mental health act 2014 all people recieving mental health treatment have capacity to make decision on their treatment.
A person lack capacity when:
If he or she is detained or sectioned under some section of mental health act.
If he or she does not have the capacity to decide whether to have treatment.
If it is emergency life saving treatment and patient or family cannot give consent.
